Court to Reexamine Decision That Allowed Former President to Deploy Troops to Oregon City

Judicial Panel Agrees to Reconsider Legal Matter

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the legal dispute concerning the executive power with an expanded group of 11 judges. The court also overturned a previous ruling from a smaller judicial group that had supported the federal government.

Ongoing Dispute Over Military Presence

This order represents the most recent turn in a protracted legal battle over whether the administration has the authority and justification to send state military units in Portland. Approximately two hundred troops have been in uncertainty since the end of September when the deployment effort was started in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that federal officials at the immigration center in the southern part of the city were facing threats, while local authorities maintain that municipal police have control of the situation.

In defiance of characterizations of Portland as a conflict zone, locals have been posting footage of scenic paths and a thriving food scene, and planning activities such as an protest bicycle event against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in Portland issued two legal injunctions this month – one blocking the federalization of the Oregon national guard, and another stopping the deployment of any military personnel in Oregon, after attempts to evade the initial injunction by calling up troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing control of state troops – but the second ruling remained in place, blocking the physical sending of the forces.

The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration simultaneously – by a panel of eleven justices.

“This ruling demonstrates that facts are important and that the courts are striving to hold this administration accountable. The constitution restricts the executive authority, and local populations cannot be treated as a testing site for expansive government power,” stated the state attorney general in a official comment.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into US cities without cause. We will continue protecting Oregon’s laws, principles, and autonomy as this legal proceeding progresses and our fight continues in the judicial system.”
